Your Commitment To Us

Please read and ask any questions that you may have. This document covers a lot but here is some of the key factors we like to be upfront and clear about before you join.

  • You are billed on the 1st of each month

  • All our memberships have a 60 day notice period. If you wish to cancel this must be done via email to info@theconfidencecoach.fitness. This must be done before the 1st of the month. If received on or after the 1st of the month you will still need to pay for any payments that land within 60 days from that date.

  • It is not possible to freeze memberships, except due to exceptional circumstances where it is medically impossible to use The Confidence Coach services. In this case, a signed medical certificate will be required as proof. The Confidence Coach offers extensive on-line and remote coaching and programming options so that services can be accessed whatever the location.


THIS MEMBERSHIP AGREEMENT (the "Agreement"), which includes particulars pursuant to the Consumer Rights Act 1996, is entered into upon starting your membership.

BETWEEN:

1.         The Confidence Coach LTD, a Limited company located at Meadowfield, Ponteland, Newcastle, NE20 9SD and
2.         (the "Member" or "you").

IT IS HEREBY AGREED as follows:


Definitions and Interpretation

1.         In this Contract, except to the extent that the context otherwise requires, the following terms shall have the meanings set forth below:

2.            Services: The membership entitles the usage of The Confidence Coach facilities and the equipment & services available therein. The membership gives access to all The Confidence Coach sites, except if specified otherwise.

3.            Membership: The membership is personal, and cannot be shared.

4.            Age Limit: The Member confirms that he/she is 18 years old or older. For persons 16 or 17 years old, exceptions are granted based on a written parental consent. Persons under 16 years of age must be supervised at all times.

5.            Liability: Each Member of The Confidence Coach shall be liable for any property damage and/or personal injury caused by the Member on the The Confidence Coach premises. It shall be the obligation of the Member to pay for any costs involved upon presentation of a statement thereof.


Waiver of Liability: Any and all use of the The Confidence Coach facilities shall be at Member’s own risk at all times. The Member shall not utilise any equipment unless he/she knows the appropriate usage. The Confidence Coach shall not be liable for any injuries, physical impact or damages to the Member, or the property of the Member, or be subject to any claim arising out of the use of the premises and/or of the equipment made available to the users.

6.       Lockers for Personal Belongings: Lockers are available for Members while working out in the facility. Each Member needs to empty the locker when leaving the facility. The Confidence Coach will open and empty lockers if the Member is not in the facility.

7.       Lost Property or Theft: The Confidence Coach does not take responsibility for loss or theft of any personal belongings. Any items left on The Confidence Coach premises will be kept for a period of two weeks before being disposed of.

8.       Code of Conduct: The Member shall respect the behavioural and operating principles of The Confidence Coach, as laid out in our code of conduct.

9.       Suspension/Termination of Membership: If the Member behaves in a way that breaches the code of conduct membership can be suspended or terminated at management’s sole discretion.


10. Payment: The Member is responsible for the payment of the membership. This is true even if the amount is debited directly by The Confidence Coach. Agreed price only applies if the Member pays according to the agreed conditions.

11. Monthly Rolling Agreement: The first month’s payment or pro-rata amount and any sign-up fee are paid at the point of this agreement. The following monthly payments should be paid before each new month. The Member is responsible for all payments, also in the case of automatic debits by The Confidence Coach and the Member has given approval for an automatic debit from his/her account or card and any wish to cancel must be announced with a minimum of a 60 day notice, to include all payments scheduled to be made during this period. All our monthly memberships are billed on the 1st of each month.


If the payment is late the member will receive a reminder email from The Confidence Coach and access may be suspended. The membership continues to run even if the access is suspended. If after 30 days the amount is still not paid, the Member is in violation of the contract and the total outstanding amount of the contract will be due. The Confidence Coach may transfer the case to a debt collector, which will add additional fees.

12. Satisfaction Guarantee: During 7 days from the start of the membership, the Member can cancel his/her membership free of charge, and will be reimbursed in full.

13. Renewal & Cancellation: We ask for a 6 hour cancellation policy on our sessions, this gives another member a chance to book in for that session. If you fail to cancel before the 6 hour cancellation window the system will automatically remove that credit from your monthly amount and will not be refunded to you.

Annual membership (12 months pre-paid): The contract runs for 12 months, during which time it cannot be cancelled. At the end of the contract period, the membership is automatically renewed, on a monthly rolling basis (with the option of paying up front for another 12 months) unless the Member sends a cancellation email to info@theconfidencecoach.fitness at least 60 days before the end of the contract period. The Confidence Coach will send a reminder via email 60 days before the end of the contract period. The member is responsible for his/her own cancellation, even if the email reminder was not received.

14. Monthly Membership: The membership extension is triggered by the payment of a subsequent month. If the Member has opted for a direct debit from an account or card, the cancellation must be announced with at least 60 days notice, with any payments due during this period to be made, by sending an email to info@theconfidencecoach.fitness.

15. Holidays: In all our memberships we include FREE additional SGPT session credits to account for time off across the year due to holiday. We do not pause your membership for holidays.

16. Exceptional Cancellation: A cancellation is exceptionally granted if the Member moves more than 25 miles away from any The Confidence Coach facility, on presentation of an official document to prove change of address. It is also possible to cancel the membership due to medical reasons, upon presentation of a medical certificate.


17. Refunds: In the event of a refund we will refund through the same methods you have purchased. This may take 5-10 working days for a card payment. In the event of a refund you will be liable for any charges for transactions. Refunds are only applicable if the rest of our membership has been followed correctly.

18. Price Changes: Prices may increase in line with inflation, on an annual basis, on January 1st.
